(PatriotWise.com) — Manhattan DA Alvin Bragg has no authority to prosecute Trump, according to a former member of the Federal Election Commission. Von Spakovsky said Bragg is pursuing Trump on federal charges, which are not within his jurisdiction. “No local state prosecutor has the authority to enforce federal campaign finance crimes in the first place,” he said. He added that Bragg could convince a left-wing jury to convict Trump regardless of the evidence, the facts, or the law.
Spakovsky strongly denounced the indictment against the former President and said it resulted from Alvin Bragg’s political ambitions and his desire to impress the Democratic Party. He added that Trump could appeal on the grounds of jurisdiction if convicted, but whether he gets justice will depend on whether politics outranks the law in the appellate courts.
The remarks will provide legitimacy to the insistence of Republicans that Bragg is overstepping the mark and pursuing a case against Trump to damage his campaign for the White House in 2024. Senator Ted Cruz from Texas was among the first to come to the former President’s defense and dismiss the indictment as a sham. “The Democrat Party’s hatred for Donald Trump knows no bounds. The substance of this political persecution is utter garbage. This is completely unprecedented and is a catastrophic escalation in the weaponization of the justice system,” he said.
Most of the American public agrees. A Quinnipiac poll in late March showed that more than 60% of Americans believe the indictment was political. Only 32% believe it was a matter of law. A Reuters/Ipsos survey around the same time found that 54% also thought it was motivated by politics rather than law.
Trump is the first and only US President to face criminal charges. The Manhattan District Attorney indicated him on 34 felony counts related to his lawyer’s payment to adult film star Stormy Daniels in 2016. Daniels alleged she had an affair with Trump, which he has consistently denied.
