
(PatriotWise.com) — US District Court Judge Aileen Cannon’s decision to dismiss the federal indictment against Donald Trump for his mishandling of classified documents was a welcome surprise on the first day of the Republican National Convention.
Cannon granted the former president’s motion to dismiss last Monday, saying in her decision that Attorney General Merrick Garland’s appointment of Jack Smith as special counsel violated both the Appointments and Appropriations clauses of the Constitution.
Cannon argued in her dismissal that if the executive branch wanted Smith to investigate and prosecute Trump, it should have taken the appropriate route of first having him nominated and then confirmed by the US Senate.
Trump’s defense argued in its motion that Smith’s appointment was illegal because, as a private citizen who was not confirmed by the Senate, he did not have the constitutional authority to represent the United States in a federal investigation and prosecution.
Cannon agreed, writing in her decision that it was clear that no statute authorized Attorney General Garland to appoint Smith to conduct the prosecution of the former president.
While Cannon’s decision was met with anger by Democratic lawmakers and the media, who called for her removal from the federal bench, it was broadly celebrated by Trump’s allies in Congress.
Florida Republican Rep. Matt Gaetz suggested in a post on X that the Trump-appointed judge should be a future pick for the US Supreme Court.
Republican Senator Marco Rubio celebrated Cannon’s decision in a one-word post on X: “Dismissed!”
Georgia Rep. Marjorie Taylor Greene, an outspoken supporter of the former president, warned Trump supporters that the classified documents case was far from over.
She said while Jack Smith was “dealt a major blow,” Democrats would not stop going after “every single one of us” for opposing their agenda. She urged her followers to “keep pushing forward.”
In a statement following Cannon’s dismissal, the special counsel’s office said that the Justice Department authorized the special counsel to appeal the ruling.
